工程索赔费用报告书

一、索赔成立

1、与合同对照,事件已造成了承包人工程项目成本的额外支出或直接工期损失。

2、造成费用增加或工期损失的原因,按合同约定不属于承包人的行为责任或风险责任。

二、工程索赔的依据

按照现行法律法规、合同文件及工程惯例, 《合同法》第284条规定:“因发包人的原因致使工程中途停建、缓建的,发包人应当采取措施弥补或者减少损失,赔偿承包人因此造成的停工、窝工、倒运、机械设备调迁、材料和构建积压等损失和实际费用。” 合同文件按照甲乙双方签订的施工合同,工程惯例主要参考清单计价规范以及相关施工规范。

三、索赔事项概述

由我单位承建的,于2013年12月27日举行开工典礼,于2013年12月28日我单位积极组织进场,投入大量机械设备和人员以确保施工工期。然自2014年3月6日起,由于建设方联系的外借土方未到场,现场处理停工、半停工状态,至2014年4月26日开始复测a区缺土方量,最终确定由我单位在红线以外进行开挖借土,用于场地土方回填。开挖时间为2014年4月28日,延期时间为54天。

根据甲方提供的地质勘测数据显示,钻探1号孔至4号孔、6号孔至12号孔开挖至设计标高全部为土方。现场施工过程中发现1号孔至4号孔、6号孔至12号孔都存在大量石方,局部存在成片大量石方,与原设计地质情况不符,从而增大了施工难度和增加了施工时间。

根据甲乙双方签订的施工合同;专用合同条款项中因发包人原因导致工期延期外借土方不到场情况,对工期进行索赔54天。

通用条款中项发包人向承包人提供地质勘察资料等相关基础资料,并对所提供资料的真实性、准确性和完整性负责;通用条款中项因基础资料存

在错误、遗漏导致承包人解释或推断失实的,由发包人承担责任。

四、索赔项目

索赔事件性质分以下几种:1、工期延长索赔,2、工程变更索赔,3、工程中断索赔,4、工期终止索赔,5、工程加速索赔,6、意外风险和不可预见因素索赔,7、其他原因索赔。

结合实际情况本项目主要存在工期延长和工程变更, 其中工期延长索赔分以下几部分组成:

1、人工费:由于非施工单位责任导致的工效降低所增加的人工费用;法定的人工费增长以及非施工单位责任工程延误导致的人员窝工费和工资上涨费。

2、施工机械费:因索赔事件发生,额外工作增加的机械使用费,工效降低以及机械停工、窝工的费用,现场使用机械均为租赁设备按照实际租金计算。

3、管理费:因索赔事件发生,额外增加的现场管理和公司管理费,按照合同约定的单位时间内现场管理率乘以延长工期计算。

4、利息:主要为履约保证金拖期付款利息。按照按中国人民银行规定的同期贷款利率计算。

5、措施费:包含环境保护、临时设施、安全、文明施工费用和大机进出场及安拆费。按照合同约定的单位时间内现场管理率乘以延长工期计算。

工程变更的索赔包含成本、管理费和利润的索赔。

五、索赔计算

一、工程延期索赔

1、人工费:工日:17×54工日=918工日

人员窝工按照定额单价乘以,

元××918=35960元

工资上涨费不予考虑。

2、施工机械费:

挖机350型2台市场租赁价48000元/月,推土机16t2台市0场租赁价24000元/月,压路机20t2台24000元/月。

48000元×54÷30×2=172800元

24000元×54÷30×4=172800元

3、管理费

合同工期120天,现延期54天,投标管理费为元

工程延期管理增加费用:÷120×54=558427元

4、利息

履约保证金115万元,按照现行中国人民银行规定的同期贷款利率计算。

二、工程变更的索赔

六、索赔说明

此项目索赔未提出以外风险和不可预见因素索赔以及其他索赔,主要包括因为工程延期造成雨季来临对施工的影响,中期计价支付延期产生的费用,施工期间由于图纸延期造成的误工,工程量增加产生的利润和管理费的索赔,工程排污费、社会保障及住房公积金和危险作业意外伤害保险费。

索赔函是指买卖中的任何一方,以双方签订的合同条款为根据,具体指出对方违反合同的事实,提出要求赔偿损失或维护其他权利的书面材料。

2、索赔函的理由

①质量低劣。

④运输拖欠。

3、索赔函的结构

索赔函的结构一般由标题、编号、受书者、正文、附件、签署等六部分组成。

(1)标题

①标题的形式比较灵活,既可以根据实际情况写成包括索赔事由文种的完全标题样式,如:《关于××的索赔函》。

②也可以简明扼要地写成不包括索赔事由而只写文种的简单标题形式,如:《索赔函》。

(2)编号

编号是为了联系与备查用,写在右上角。一般由年号、代字、顺序号组成。

(3)受函者

写受理索赔者的全称。

(4)正文

①缘起:提出引起争议的合同及其争议的原因。

②索赔理由:具体指出合同项下的违约事实及根据。

③索赔要求和意见:根据合同及有关国家的商法、惯例,向违约方提出要求赔偿的意见或其他权利。

(5)附件

为解决争议,以有关的说明材料、证明材料、来往的函电作为附件。

(6)签署

要写明索赔者所在地和全称及致函的日期。
